This policy will outline the contractual agreement formed by you and our service when viewing or using our service.
ACCEPTING OUR TERMS
Welcome to ‘The Infraction’. The Infraction, its officers, directors, agents, employees, volunteer staff, staff and other designees (collectively "Us", "We", "Our") provides its service to a single human you ("You", “Your”, “Yourself”), subject to the following Terms of Service ("TERMS OF SERVICE"). These terms and conditions are subject to revision at any time, with or without notice. By continuing with registration, you explicitly agree to the terms listed herein and further agree to be bound by them.
NATURE OF SERVICE
Themes of an adult nature will be prevalent within the use of our service; in different forms such as but not limited to text and graphics, therefore we strongly recommend that adults use our service. If you are a minor, we recommend that you seek parental guidance before continuing.
Regardless of age, all users of our service must be aware of the compliance and consequences of all terms stated within this agreement.

YOUR OBLIGATIONS
Although we aim to provide the safest game-play experience possible, we recommend that you do not reveal personal details about yourself within our service (unless authorised by staff), such as; full name, date of birth, address, telephone number, email address. Any and all details given to other players will be solely based on your discretion and we do not take responsibility for such.
It is your sole responsibility to contact and/or check with your ISP (Internet Service Provider) regarding data usage charges prior to using our service, we do not take any responsibility on any extra charges you may incur.
You are required to give us completely accurate and truthful data, information and credentials and it is your sole responsibility to keep this information regularly updated. If staff have reasonable suspicion that any information is inaccurate, we have the right to terminate and/or suspend your account and the right to use our service temporarily or indefinitely.
DISCLAIMER NOTICE
All names, usernames, characters, images, designs, artwork, storyline, company names and/or companies portrayed within our service are completely coincidental and all works are purely fictional for entertainment purposes only.
MODIFICATION AND TERMINATION OF SERVICE
We are entitled to modify and/or discontinue the service temporarily or permanently at any time with or without notice. We are not liable for any loss, financially or otherwise.
CURRENCY, SALE AND DIAMONDS
We are not responsible or liable for the loss, deduction and/or removal of “Diamonds” on your account after our service has provided you with them; we are only responsible for you not receiving “Diamonds” immediately after purchase. This is only if the “Diamonds” have not been added to your account within 2 hours after initial payment.
You are not permitted to sell, lease and/or lend “Diamonds” for real currency (this includes all and any world currency) while using our service and/or outside of using our service.

ADMINISTRATION OF SERVICE
Members of staff are in no way required to reply to any personal messages sent to them by you, if a question or problem arises; the help-desk system within the “Help Centre” feature must be used.
Buying or selling of “Diamonds” between you and other parties should strictly be done via the “Marketplace” or the “Escrow Service” feature within our service; using any other medium for such transactions is strictly prohibited.
You are prohibited to discuss account suspensions with any individual other than staff, this includes posting information/details regarding the suspension through any communication medium including forums and messages. You are also prohibited to communicate with the player whom of which is suspended about their suspension.
It is your sole responsibility to deal with transactions including but not limited to, cash, money, cars, items and diamonds with the upmost vigilance as the integrity of every single player is not monitored.
Interfering with the quality of the service which includes but is not limited to using web or software proxies to bypass the system in any and all ways is strictly prohibited.
You must use features as they are intended to be used, such uses are stated within the feature pages themselves and stated within the ‘Help Desk’ feature, or by a member of staff. Other uses for any and all features are strictly prohibited.
Communicating through any medium stating that you have multiple accounts, have cheated, have exploited errors and/or bugs, or have made an attempt to reduce the quality of the service (whether intentional or not) is strictly prohibited.
When viewing this website or signing into your account, your sole purpose must be to play. Using your account to hold in-game cash and/or money while being inactive on the stated account is strictly prohibited.
Purchasing “Diamonds” on any other medium other than the ‘Diamond Store’ feature within our service is strictly prohibited.
Members of staff are given the right to have a separate account other than those stated with the label “Head Administrator”, “Administrator” and “Moderator” (“Maintenance” staff members are excluded) for the sole purpose of tracking and suspending players whom of which have broken one or more of the rules stated within these terms. These separate accounts will in no way transfer, trade, sell, lease and/or buy any in-game items which include but are not limited to cash, money, cars, items, and “Diamonds” which have not been gained through playable means.
Your account is liable for indefinite suspension under the sole discretion of the staff if you do not abide by the terms under this section (“ADMINISTRATION OF SERVICE”).
SECURITY AND PERSONAL DATA
Our service receives and records information such as your IP address, cookie data, personal data, browser data and any other form of personal data. We may use this information to provide you with a better service, we may also use it in other ways, such as; send you personally marketed emails. We have the right to transfer information to a separate company if we decide to merge. This information may also be transferred to a lawful authority if required, however you will be notified if such an event occurs.
Our service does not ensure the automatic detection and/or prevention of offensive material through any or all of our communication methods, therefore it is your responsibility to use the ‘Help Desk’ feature to create a ticket regarding any offensive material that other players have sent, posted and/or submitted.
Promotion and submission of any harmful program, software or website which include but is not limited to viruses, worms, trojans, adware, spyware and/or display of fraudulent data and information is strictly prohibited.
Access to any administrative area of our service is strictly prohibited, this includes but is not limited to the attempt to access any administrative area and/or function which is not given to the standard player account.
Disruption, interference, change and/or removal of variables and/or functions within our service is strictly prohibited, this includes but is not limited to denial-of-service attack and distributed denial-of-service attack.
By breaching the stated terms above, you would be committing a criminal offense (under the “Computer Misuse Act 1990”). Such breaches will be reported immediately to the relevant law enforcement authority, details of your identity will also be showcased where needed. If such a breach should occur; your right to use our service will be immediately and indefinitely terminated.
We are not responsible or liable for any loss and/or damage caused by such attacks stated above, although we will try our upmost to prevent such attacks and/or events occurring.

SUSPENSION AND TERMINATION
Termination of player accounts, which includes temporary and indefinite suspensions; will be completely up to the member of staff dealing with the specific issue. Whether or not a breach has occurred and to what extent is based on the sole discretion of the staff member involved.
An appeal system is accessible to you if your account has been suspended; you will be able to communicate with a member of staff to answer any queries through this system.
By using our service, you completely agree and comply with the “Terms and Conditions” collective in whole, which includes the “Terms of Service”, “Game Rules”, “Terms of Purchase”, “Privacy Policy” and “Cookie Policy” documents and policies. We grant you a personal non-transferable non-exclusive right and license to use the object code of our service on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in our service.
You agree not to modify our service in any manner or form, or to use modified versions of our service, including (without limitation) for the purpose of obtaining unauthorised access to our service.
LINKS AND ASSOCIATION
You are authorised to advertise or post the homepage link of our service (“theinfraction.com” or “theinfraction.co.uk”) on any website, system, company for any purpose other than to damage the reputation of our service and/or for any other purposes we deem as not standard.
Advertising or posting the homepage link of our service (“theinfraction.com” or “theinfraction.co.uk”) in a way which induces the association, approval or endorsement of our service, where it is non-existent.
Advertising or posting a link from our service other than the homepage is strictly prohibited.
Our service has the right to withdraw any links posted within our service or the linking of our service within any and all other websites, systems or companies.
Third-party websites may be linked on our service; these links are not owned nor controlled by our service, therefore we accept no responsibility for the information displayed on them and/or for any damage or loss that may arise from using them.
JURISDICTION AND APPLICABLE LAW
The courts within England, United Kingdom will have first-hand jurisdiction over any claims that arise or be related to, a visit or use of our service, although we still retain the right to create and/or bring proceedings against you for breach of any of the documents within the “Terms and Conditions” collective (which includes “Game Rules”, “Terms of Service”, “Terms of Purchase”, “Privacy Policy” and “Cookie Policy”).

BETA TESTING PHASE
Our service is subject to change in whole or in part at any time, any of the internal coding, structure, databases, graphical elements, which includes but is not limited to the features and functions that you may use.
Regular updates will be implemented to our service; improving specific elements of those features and functions, such as security to ensure bugs are found and made obsolete. This in no way can be controlled and can occur at any time, with or without notice.
REVISIONS
Any and all documents within the “Terms and Conditions” collective (Game Rules, Terms of Service, Terms of Purchase, Privacy Policy and Cookie Policy) are subject to change at any time. Although we may send you notifications of any changes, revisions and/or updates if you hold an account with us, we are not obliged to. Therefore, it is your sole responsibility to regularly check these terms.
